On Friday, a federal court refused Hunter Biden’s motion to dismiss a firearms lawsuit against him, which his lawyers believe is politically motivated.
U.S. District Judge Maryellen Noreika denied all of Biden’s motions, citing vindictive and selective prosecution, so bringing the matter forward to trial.
The son of President Biden is accused of lying about his drug usage on a federal form when he purchased a weapon in October 2018, during which time he admitted to struggling with crack cocaine addiction.
Hunter pled not guilty
He denied fabricating information on federal firearm papers and owning a firearm while on illegal narcotics.
The first son’s legal team claimed that their client was unfairly targeted because of his family ties to the present President.
However, the federal judge pointed out that the attorney general in charge of appointing Special Counsel David Weiss, who is leading the prosecution against Hunter, was nominated by the president himself.
In her decision, Judge Noreika observed, “The Executive Branch that charged Defendant is led by the sitting President – Defendant’s father. The Attorney General who leads the DOJ was appointed by and reports to the Defendant’s father. And that Attorney General chose the Special Counsel who made the challenged charging decision in this case while the defendant’s father was still President.”
She also denied the suggestion that Hunter Biden was being prosecuted because of his relationship with his father, calling the argument “nonsensical under the facts here.”
